HOW IT WORKS
The debt assignment is the assignment of a specific right that the assignor (creditor) transfers to a buyer (assignee) who buys it at a certain price. When a company decides to assign its credits to third parties has two options:
- Assignment without recourse (pro soluto)
- Assignment with recourse (pro solvendo)
In case of assignment without recourse, assignor ensures the sole existence and validity of the debt at the time of the assignment. Differently, in case of assignment with recourse, assignor ensures both existence and validity of the debt and also guarantees the debtor solvency.
